1. Acceptance of Terms

By creating an account, accessing, or using the Zing² Electric NEC Assistant ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of a business or entity, you represent that you have the authority to bind that entity to these Terms.

2. Nature of the Service

Zing² is a productivity tool designed to assist electrical professionals with calculations, code navigation, and job planning.

Important Notice: Zing² is not a substitute for professional training, official code books, or the judgment of a licensed Master Electrician or Professional Engineer.

3. Safety Disclaimers

3.1 Engineering Advice

The content, calculation results, and AI responses provided by Zing² are for informational and estimation purposes only. They do not constitute professional engineering, architectural, or electrical advice.

3.2 Risk Acknowledgement

You acknowledge that electrical work involves significant risks, including fire, property damage, serious bodily injury, and death.

  • Independent verification against official NEC & local AHJ is required.
  • Work must be performed by qualified personnel (NFPA 70E compliance).

3.3 AI Probabilities

The "Chat" feature utilizes Large Language Models (AI). By using this feature, you acknowledge:

  • AI models can generate incorrect information ("hallucinations").
  • All code citations and verdicts must be independently verified.
  • Zing² assumes no liability for AI-generated outputs.

4. Access and License

Subject to your payment of applicable fees, Zing² grants you a limited, non-exclusive, non-transferable license for internal professional purposes.

Prohibited Actions:

  • Reverse engineering the source code or algorithms.
  • Sharing account credentials with unauthorized users.
  • Automated data scraping or extraction.
  • Using the service to train competing AI models.

5. Billing and Subscriptions

  • Subscription Basis: Services are offered on a monthly or annual subscription basis processed via Stripe.
  • Automatic Renewal: Subscriptions automatically renew unless canceled at least 24 hours before the renewal date.
  • Refunds: Payments are non-refundable except where required by law.

6. Intellectual Property

The interface, calculators, and proprietary code are the property of Zing². NEC citations are the property of the NFPA. Users must ensure they have lawful access to official standards.

7. Limitation of Liability

MAXIMUM PERMITTED BY LAW

In no event shall Zing² be liable for loss of profits, business interruption, property damage, or personal injury. Total liability is capped at the amount paid by you in the 12 months preceding the claim.

8. Indemnification

You agree to defend and hold harmless Zing² against any claims arising from your violation of these Terms or your use of data obtained from the Service.

9. Modifications

Zing² reserves the right to modify or discontinue the Service at any time. Pricing and features are subject to change.

10. Data Collection & Privacy

10.1 Information We Collect

To provide and improve our Service, we collect:

  • Account Information: Email address and name when you register.
  • Usage Data: Search queries, calculator inputs, and feature usage patterns.
  • Technical Data: IP addresses, browser type, and device information.
  • Payment Data: Processed securely by Stripe; we do not store full payment details.

10.2 How We Use Your Data

  • Service Delivery: To provide personalized responses and save your history.
  • Security & Abuse Prevention: IP addresses are logged to detect automated abuse, rate-limit requests, and investigate security incidents.
  • Product Improvement: Aggregated, anonymized usage patterns help us improve features.
  • Communication: Account-related notifications and optional product updates.

10.3 Legal Basis (GDPR)

We process your personal data under the following lawful bases:

  • Contract Performance: Processing necessary to deliver the Service you subscribed to.
  • Legitimate Interests: Security logging (IP addresses), fraud prevention, and service improvement where our interests do not override your rights.
  • Consent: For optional communications where applicable.

10.4 Data Retention

  • Account data is retained while your account is active.
  • Security logs (IP addresses) are retained for 90 days.
  • Chat history is retained until you delete it or close your account.
